Sharyn Hodges Photography is the responsible party for personal information processed through this website and in connection with enquiries, bookings, photography services and direct product purchases.

This policy applies to website visitors, prospective clients, clients, people included in enquiries, product customers, suppliers and others who communicate with Sharyn.

Information may be collected when you complete an Elementor form, email or message Sharyn, use a booking calendar, sign an agreement, make payment, purchase a product, access a gallery, request image permission, subscribe to updates or interact with the website.
Some information may come from a partner, venue, planner, supplier, referral source, payment or booking provider, public social profile or another person involved in your event. Technical information may be collected automatically through cookies, server logs, analytics and embedded services.

Sharyn processes personal information only where there is an appropriate reason under the Protection of Personal Information Act. Depending on the situation, this may include your consent, steps requested before entering a contract, performance of a contract, compliance with a legal duty, protection of a legitimate interest, or Sharyn’s legitimate business interests where your rights do not override them.
You may withdraw consent where processing depends on consent. Withdrawal does not make earlier lawful processing invalid and may affect a service that requires the information.
Marketing emails or updates will be sent where you have opted in or where another lawful basis allows communication. Marketing consent is optional and is separate from sending an enquiry.

Payment and booking information may be retained where needed for service delivery, accounting, fraud prevention, disputes and legal obligations.
Photographs and videos of identifiable people can be personal information. Their capture, editing, delivery, storage, sharing and portfolio use are managed according to the photography agreement, releases, gallery settings, legitimate purpose and applicable law.
Clients are responsible for using gallery links and download permissions carefully. Please tell Sharyn promptly if a private gallery link may have been shared with the wrong person.

Providers should receive only the information reasonably needed for their role and are expected to protect it.
Some website, email, gallery, cloud, analytics, social media or payment providers may process information in countries outside South Africa.
Where personal information is transferred across borders, Sharyn will take reasonable steps to use providers and arrangements that offer appropriate protection consistent with applicable law, including section 72 of POPIA where it applies.
Personal information is kept only for as long as reasonably needed for the purpose for which it was collected, an active relationship, archival and service needs, dispute resolution, enforcement of agreements, or legal, tax and accounting requirements.
Different records have different retention needs. Enquiries that do not become bookings may be deleted or anonymised when no longer useful. Contracts, invoices and payment records may be kept for legally required periods. Photographic files and galleries may be retained according to the client agreement, backup practice and legitimate archival needs.
Marketing information is kept until you unsubscribe or it is no longer needed, subject to suppression records used to respect an opt-out.
Sharyn uses reasonable technical and organisational safeguards appropriate to the nature of the information and the tools used. These may include access controls, passwords, trusted providers, backups, updates and limited access to client information.
No internet transmission or storage system is completely secure. If a security compromise creates a legal notification duty, Sharyn will take reasonable steps to investigate, reduce harm and notify the Information Regulator and affected people as required.
Subject to applicable law, you may ask whether Sharyn holds personal information about you and request access to it. You may also ask for inaccurate information to be corrected, request deletion where appropriate, object to certain processing, withdraw consent, or complain about how information is handled.
Some requests may be limited where information must be kept for a contract, legal obligation, the rights of another person, or the establishment, exercise or defence of a legal claim.

The website is not intended for children to submit enquiries or purchases independently. Family photography may involve children, and related information and images are handled through the parent, guardian or contracting client’s instructions and the applicable agreement.
If you believe a child has submitted personal information without appropriate involvement from a parent or guardian, contact Sharyn so the matter can be reviewed.
Links to Instagram, Facebook, venues, suppliers, payment pages, calendars and other websites take you to services controlled by third parties. Their privacy notices apply to information they collect.
