About these terms
These Terms and Conditions govern your use of the Sharyn Hodges Photography website and any website-based enquiry, booking or purchase journey. By using the website, you agree to these terms. If you do not agree, please stop using the website.
Sharyn Hodges Photography is based in Plettenberg Bay, South Africa. You can contact Sharyn at info@sharynhodges.com.
These website terms are separate from a photography agreement, quotation, invoice, image licence or gallery terms. Where a specific signed agreement or written confirmation applies to a service, booking or photograph, that document takes priority for that matter.
Using this website
You may browse and use the website for lawful personal or business purposes connected with learning about Sharyn’s work, making an enquiry, managing a booking or purchasing an available product.
You may not interfere with the website, attempt unauthorised access, introduce malicious code, impersonate another person, submit unlawful material, copy substantial parts of the website, or use automated tools to scrape content without written permission.
Website content and photographs may not be collected for AI training, synthetic image generation, datasets, facial recognition or similar automated uses without Sharyn’s prior written permission.
Enquiries, availability and bookings
Sending a form, email or booking request does not reserve a date or create a photography agreement. Dates remain subject to availability until the booking steps set out in Sharyn’s written quotation, invoice or agreement have been completed.
Please provide accurate information, including names, contact details, dates, locations and the type of photography required. If plans change, tell Sharyn as soon as reasonably possible.
Any response time shown on the website is a helpful guide, not a guarantee. Please check your spam folder and contact Sharyn directly if an expected reply has not arrived.
Photography services and signed agreements
The scope of coverage, deliverables, editing, timelines, travel, weather plans, postponements, cancellations, model releases, gallery access and image-use permissions are governed by the written agreement and invoice for the relevant booking.
Photography is affected by light, weather, access, schedules, guest behaviour and other real-world conditions. Sharyn will use professional judgement and reasonable care, but a particular photograph, pose, location, weather condition or exact recreation of another image cannot be guaranteed.
If information on this website differs from the signed agreement for your booking, the signed agreement controls.
Pricing, quotations and payment
Prices are shown in South African rand unless stated otherwise. A package page is a guide and may be updated. Your quotation or invoice will confirm the price, inclusions, travel costs, taxes where applicable, due dates and accepted payment method for your booking.
A quotation may be time-limited and does not guarantee availability until the required booking steps are complete. Payments must be made using the details or approved payment link supplied by Sharyn.
Online payments may be processed by PayFast or another provider identified at checkout. That provider processes payment information under its own terms and privacy policy. Sharyn generally receives transaction confirmation rather than your complete card details.
Calendars, prints and digital products
Product pages may offer marine calendars, prints, presets, guides or other physical and digital products. The product page or checkout will confirm the current description, price, availability and any delivery or collection details.
An order is subject to successful payment and availability. If a physical product becomes unavailable after payment, Sharyn will contact you about an appropriate replacement, delay or refund as required by applicable law.
Please check delivery details before paying. Estimated delivery dates are not guarantees where delays are caused by couriers, customs, weather, inaccurate addresses or circumstances outside Sharyn’s reasonable control.
Digital products are licensed for the use stated at purchase. Buying a digital file does not transfer copyright or allow resale, sharing, copying for others or redistribution unless written terms expressly permit it.
Cancellations, refunds and consumer rights
Cancellation, postponement, rescheduling and refund terms for photography are set out in the relevant signed agreement. Product-specific return, refund or replacement information may also appear on the product or payment page.
If you need to change or cancel something, contact Sharyn promptly so the available options can be considered. Eligibility for a refund depends on the relevant agreement, the nature of the service or product, work already completed and applicable law.
Nothing in these terms excludes or limits rights that cannot lawfully be excluded, including rights that may apply under the Consumer Protection Act and the Electronic Communications and Transactions Act.
Copyright and intellectual property
The website design, words, branding, photographs, videos, graphics, downloads and other content are owned by Sharyn Hodges Photography or used with permission. All rights not expressly granted are reserved.
You may not copy, republish, sell, adapt, remove credits or watermarks, create derivative works, or use content commercially without the required written permission.
Photography permission is explained on the Photo Usage and Licensing page. Credit is appreciated, but credit alone does not create permission.
Information and material you submit
When you submit information, you confirm that it is accurate and that you are entitled to provide it. This includes information about a partner, child, guest, venue, supplier or other person.
Do not submit content that is unlawful, threatening, discriminatory, misleading, defamatory, infringing or unrelated to a genuine enquiry or booking.
You allow Sharyn to use the submitted information to respond, assess availability, prepare a quotation, manage a booking, provide the requested service and meet legal or administrative obligations. Personal information is handled under the Privacy Policy.
Third-party links and services
The website may link to venues, suppliers, social platforms, calendars, galleries, maps, payment providers and other third-party services. These services are operated independently and have their own terms, privacy practices and availability.
A link does not guarantee or endorse every statement, service or result offered by that third party. Please review the third party’s terms before providing information or making payment.
Website availability and accuracy
Sharyn takes reasonable care to keep website information useful and current. Content, packages, dates, links and availability can change, and occasional errors may occur.
The website may be interrupted for maintenance, updates or technical reasons. To the fullest extent permitted by law, the website is provided without a guarantee that it will always be available, error-free or suitable for every purpose.
Liability
To the fullest extent permitted by law, Sharyn Hodges Photography is not liable for indirect, incidental or consequential loss arising only from use of, or inability to use, the website or a third-party website linked from it.
Liability relating to a booked photography service or purchased product is governed by the relevant agreement and applicable law.
Nothing in these terms excludes liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.
South African law and disputes
These website terms are governed by the laws of the Republic of South Africa. Before starting formal proceedings, please contact Sharyn at info@sharynhodges.com so the issue can be considered in good faith.
Subject to any consumer right to use another forum, South African courts will have jurisdiction over disputes relating to these website terms.
